Mediation is on the rise but still relatively little known. A mediation is conducted by a licensed mediator, a legally recognized and protected title. This means that agreements made with a licensed mediator leads to legally valid agreements. The agreement can be homologated by the court at the request of either party, giving it the same force as a “judgment” rendered by the court.
In mediation, the parties hold the reins of power. The mediator guides the parties to a sustainable agreement.
A mediation is conducted under the conditions of independence, voluntariness, and confidentiality. In particular, confidentiality is an asset for conflicts that are sensitive to the parties and/or the organization. Confidentiality is valid for the mediation process but can be kept confidential even after the preparation of the agreement at the request of (all) parties. This makes mediation by a licensed mediator ideally suited for conflicts involving sexually transgressive behavior, harassment and so on.

STEP 1: DISCOVERY & EXPLORATION
We start every collaboration by listening to each other. Our goal is to understand your organization, your ambitions and your strategic challenges.

STEP 2: NEEDS ANALYSIS
Our experts conduct a more in-depth needs analysis to gain a solid knowledge of development needs. At the end of this process, we document the training goals and core training themes in an agreement.

STEP 3: DESIGN
After this consultation, we design the learning process, designate speakers, facilitators and experts who will deliver the training. We coordinate the content of the training and arrange all practical matters for a smooth delivery.

STEP 4: IMPLEMENTATION
Our facilitators are (international) experts who actively share their knowledge and experiences with our participants. Our intention is to actually touch, inspire and enthuse participants to change beacons. Our didactics vary each time according to the objectives of the course. Delivery is managed by a training consultant who guides participants through the learning process.

STEP 5: EVALUATION & FOLLOW-UP

Walsha is a training institute recognized by the Federal Mediation Commission under the name People Interaction.
Those who successfully complete both the basic module and one specialization module with us can apply for accreditation with the Federal Mediation Commission.
Likewise, continuing education courses are accredited by the Federal Mediation Commission.

The goal is to resolve conflicts in a sustainable manner without the intervention of the lawyer and/or legal proceedings. The agreements are legally valid and can be homologated by the court at the request of the parties, giving them the same enforceability as a court judgment.

Increasingly, we see family judges (recommending) that the parties first enter mediation in divorce cases. This is because faster and more sustainable agreements are possible through mediation.

With Divorce By Consent (EOT), the certified mediator can guide this entire process. The actual divorce, property division and parenting arrangement. These elements individually can also be themes of mediation.

Mediation finds its benefit — provided both parties are willing to cooperate constructively — in reaching a fully legally valid agreement faster, cheaper.
Mediation allows for solutions that are broader than the legislation. Matters of Public Order or Compelling Law must strictly follow legislation. This relates primarily to securing the rights and well-being of the child. So it gives more opportunities provided both parties .

The main advantage is the confidentiality of the mediation process. At the request of the parties, confidentiality may be maintained even after the conclusion of the agreement.

Conflict mediation in companies concerns all internal conflicts.
These are often labor-related conflicts ranging from conflicts between two employees in the workplace to socially related conflicts between union and management.
Examples of conflicts include sexually transgressive behavior, harassment, promotion related, resistance to organizational changes and so on.

Conflict mediation between companies concerns conflicts that are often of a commercial nature where agreements made are not carried out.
Examples include (family) conflicts in partnerships andtransfers in family enterprises.
